Kalunara Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kalunara website (the “Site”), and any purchases made through the Site. By accessing the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site.

1) Company Information

The Site is operated by Kalunara Wellness LLC (“Kalunara,” “we,” “us,” “our”).

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Site and purchase products. By using the Site, you represent that you meet this requirement.

3) Health & Supplement Disclaimer

Kalunara products are dietary supplements and/or wellness products. Content on the Site is provided for general informational purposes only and is not medical advice.

Always consult a qualified healthcare professional before using supplements—especially if you are pregnant or nursing, have a medical condition, take prescription medication, or have allergies/sensitivities.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

4) Product Use & Safety

You are responsible for reading all product labels and directions before use. Do not exceed recommended use. Stop use and consult a healthcare professional if you experience an adverse reaction.

5) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. The Privacy Policy is incorporated into these Terms by reference.

6) Orders, Pricing, and Payments

  • Currency: All prices are listed in USD ($) unless stated otherwise.
  • Availability: All purchases are subject to product availability. We may limit quantities or cancel orders at our discretion (including suspected fraud or unauthorized resale).
  • Pricing errors: If a price or product description is incorrect, we may correct it and cancel or adjust an order. If we cancel, we will refund you.
  • Taxes & shipping: Taxes, shipping, and handling (if applicable) are calculated at checkout unless otherwise stated.
  • Payment processors: Payments are processed by third-party processors. We do not store full payment card details.

7) Shipping & Delivery

  • Delivery estimates are not guarantees.
  • You are responsible for providing a complete and accurate shipping address. If a package is returned due to an incorrect address, additional fees may apply to reship.
  • If international shipping is offered, you are responsible for customs duties, taxes, and compliance with local import rules.

8) Returns, Refunds, and Exchanges

Returns and refunds are governed by our posted Return/Refund Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Return/Refund Policy, the Return/Refund Policy controls.

9) Promotions & Discount Codes

Promotions may be limited by time, product, quantity, or eligibility and may be modified or ended at any time. Discount codes have no cash value and may be void if misused.

10) Reviews, Testimonials, and User Content

If you submit content (including reviews, testimonials, photos, videos, or comments), you grant Kalunara a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and create derivative works from that content for business and marketing purposes, unless prohibited by law.

You represent that you own the content or have permission to submit it, and that it does not violate anyone’s rights.

11) Intellectual Property

All Site content (including text, graphics, logos, product names, imagery, and design) is owned by Kalunara or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, sell, or exploit any Site content without our written permission.

12) Prohibited Conduct

You agree not to:

  • use the Site for unlawful purposes
  • attempt unauthorized access or interfere with Site security
  • scrape, reverse engineer, or disrupt Site operations
  • submit false, misleading, or fraudulent information
  • misuse promotions, discount codes, or the checkout process

13) Third-Party Links and Services

The Site may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

14) Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALUNARA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS.

IN ALL CASES, KALUNARA’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO KALUNARA FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.

(Some jurisdictions do not allow certain limitations; in that case, limitations apply only to the extent permitted by law.)

16) Indemnification

You agree to indemnify and hold harmless Kalunara Wellness LLC and its owners, officers, employees, contractors, and agents from claims, damages, liabilities, and expenses arising out of your breach of these Terms or misuse of the Site.

17) Termination

We may suspend or terminate your access to the Site if we believe you violated these Terms, engaged in fraud, or created risk for Kalunara or other users.

18) Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

Any disputes will be brought in the state or federal courts located in the City and County of San Francisco, California, and you consent to jurisdiction there.

19) Changes to These Terms

We may update these Terms at any time. The “Last Updated” date will reflect the most recent version. Your continued use of the Site after changes means you accept the updated Terms.

20) Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Return/Refund Policy, form the entire agreement between you and Kalunara regarding the Site and purchases.
